Terms and Conditions
In these TOU, the following terms have the meanings set out below: “Platform”: Refers to the entire JobUnity technical solution (website, mobile application, API, servers). “Account”: The personal space dedicated to a User on the Platform. “User”: Refers to any person (Recruiter or Candidate) registered on the Platform. “Recruiter”: A legal entity or professional natural person (holding a valid SIRET number) seeking to fill an assignment. “Candidate”: A natural person seeking to carry out temporary assignments. “Assignment” (“Mission”): A temporary professional task offered by a Recruiter. “Successful Match”: The action of a Recruiter validating a Candidate via the Platform, triggering the invoicing of service fees. “User Content”: Any data, text, reviews, ratings (Poker Score) submitted by a User on the Platform. “Service Fees”: The amount owed by the Recruiter to JobUnity in the event of a Successful Match.
These TOU govern access to and use of JobUnity. JobUnity acts exclusively as a technical intermediary and administrative agent. JobUnity is neither a temporary work agency nor the employer of the Candidates. Registration on the Platform constitutes full and unconditional acceptance of these TOU.
3.1 Registration requirements Candidates: Must be of legal age, have legal capacity, and hold the necessary authorizations to work in France. Recruiters: Must be a valid legal entity (with an active SIRET number). The representative creating the Account certifies that they are authorized to bind the company. 3.2 Account security The User is solely responsible for maintaining the confidentiality of their login details. They agree not to share their Account with third parties. Any action performed from their Account is deemed to have been carried out by them. In case of suspected hacking or unauthorized use, the User must notify JobUnity immediately.
4.1 No guarantee JobUnity is provided “as is”. While we make reasonable efforts to ensure continuous service (obligation of means), we do not guarantee that the Platform will be available 24/7 or free from bugs or interruptions. 4.2 Maintenance JobUnity reserves the right to temporarily interrupt access to the Platform for technical maintenance or improvement, without such interruptions giving rise to any right to compensation.
5.1 Prohibited uses It is strictly prohibited to use the Platform to: - Create a false identity or impersonate a third party - Post fictitious or illegal assignments - Extract data in an automated manner (scraping) - Bypass or attempt to bypass security or authentication systems - Harass other Users or publish defamatory content 5.2 Accuracy of data The User agrees to keep their information up to date (CV, SIRET, bank details, etc.). Any false or misleading declaration may result in immediate suspension of the Account without prior notice.
6.1 “Pay-per-Success” pricing The service is invoiced to the Recruiter only in the event of a Successful Match (validation of the Candidate’s profile). Prices are exclusive of VAT, per validated assignment: less then a week: €35 1 to 2 weeks: €40 2 to 3 weeks: €45 1 month or more: €50 6.2 Anonymity (“Blind Matching”) Candidate contact details are hidden until payment, in order to maintain fairness of the service. 6.3 Strict Non-Circumvention Clause The Recruiter is strictly prohibited from entering into an agreement directly with a Candidate identified on the Platform, outside the Platform, for the purpose of avoiding the Service Fees. Duration: This prohibition applies for 12 months following the last presentation of the Candidate’s profile on the Platform. Sanction: In the event of proven circumvention, JobUnity will invoice a fixed penalty of €1,000 excl. VAT per proven breach, without prejudice to Account suspension and any additional damages that may be claimed.
The Recruiter grants JobUnity a mandate to generate the employment contract and to submit the DPAE (Déclaration Préalable à l’Embauche) on its behalf. The Recruiter remains solely responsible for the accuracy of the data provided (working hours, reason for hiring, identity) used for these formalities.
No-show (Candidate absence): 100% refund of Service Fees if reported within 48 hours. - Cancellation by the Recruiter (after payment): 50% refund if the cancellation occurs before the start of the assignment. - Assignment already started: No refund.
9.1 Limitation of liability JobUnity cannot be held liable for any indirect damages suffered by the User, including but not limited to loss of revenue, loss of opportunity, or damage to reputation. In all cases, JobUnity’s total financial liability towards a Recruiter is expressly limited to the total amount of Service Fees paid by that Recruiter over the previous 12 months. 9.2 Employer role The Recruiter acknowledges that it is the sole employer of the Candidate JobUnity is not responsible for any faults, accidents, or non-payment of salaries occurring in the context of the assignment.
10.1 JobUnity content All elements of the Platform (texts, graphics, logos, source code, interfaces, structure) are the exclusive property of JobUnity SASU. Any reproduction, distribution, or reverse engineering is strictly prohibited without prior written authorization. 10.2 User license By publishing content on the Platform (profile, photo, review, rating), the User grants JobUnity a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the operation and promotion of the service, for the entire duration of the User’s registration.
11.1 By the User The User may delete their Account at any time via their settings, provided that no assignment is currently in progress. 11.2 By JobUnity JobUnity reserves the right to suspend or terminate an Account automatically, without compensation, in the event of: - Breach of these TOU - Fraud or circumvention (as defined in Article 6.3) - Inappropriate behavior or a critically low Poker Score 11.3 Effects Termination does not release the Recruiter from the obligation to pay any amounts due for past assignments.
Data controller: JobUnity SASU. Purposes: Management of assignments, invoicing, service improvement, fraud prevention. Legal basis: Performance of the contract (these TOU) and JobUnity’s legitimate interest. Data are retained for the duration of the contractual relationship, plus applicable statutory limitation periods. For more details, Users are invited to consult our Privacy Policy.
These TOU are governed by French law. In the event of a dispute, exclusive jurisdiction is assigned to the courts within the jurisdiction of the Toulouse Court of Appeal. Online acceptance of these TOU has the same evidential value as a handwritten signature.
By checking the box “I accept the Terms and Conditions,” the user (candidate or company) declares that they have read and accepted all the conditions. Clicking constitutes contractual acceptance. JobUnity generates a time-stamped PDF and retains a secure audit trail as proof.
